2 SCOPE
These General Terms and Conditions in the version valid at the time of the order shall apply exclusively to the business relationship between the Seller and the Customer, unless otherwise agreed. Unless otherwise agreed, the inclusion of the Customer's own terms and conditions is hereby excluded.
The customer is a consumer if he concludes the contract for purposes that cannot predominantly be attributed to his commercial or independent professional activity.
3 CONCLUSION OF CONTRACT
The presentation of the goods does not constitute a binding contractual offer. By submitting an order, the customer submits a binding offer. The seller can then accept or reject this contractual offer. Acceptance occurs through an order confirmation or by dispatch of the goods.
The ordering process in the seller’s online shop works as follows:
The customer can select products from the seller's range and collect them in a so-called shopping cart using the "Add to Chart" button. By clicking on the "My Chart" button, the customer receives an overview of the selected products. By clicking on the "Checkout" button, the customer submits a binding request to purchase the goods in the shopping cart. Before submitting the order, the customer can change and view the entered order and the entered data at any time using the "Back" and "Forward" browser functions displayed as arrow buttons. The order can only be submitted and transmitted if the customer accepts these terms and conditions by clicking on the "I agree with the terms and conditions" button and thereby includes them in their order. The seller will then send the customer an automatic confirmation of receipt by email, which lists the customer's order again. The automatic confirmation of receipt merely documents that the customer's order has been received by the seller and does not constitute acceptance of the order. The contract is only concluded when the seller submits the declaration of acceptance, which is sent in a separate email.
Ordering is possible for both registered and guest customers. The customer can register for the first time in the next step of the ordering process by entering their personal information and selecting "Save my information and pay faster next time," or they can proceed to checkout as a guest without creating a customer account. Already registered customers can log in with their login details in this step by clicking the corresponding button.
The contract language is German.
At the bottom of the page, the customer submits all order details by clicking the "Buy" button, thereby making a binding offer. A page opens confirming the customer's order.
4 PAYMENT
You can choose between the following payment methods:

5 PRIZES
The listed prices include VAT, but exclude shipping costs. Any shipping costs will be listed separately. Section 7 of these terms and conditions applies in this regard.
6 SUBJECT OF THE CONTRACT
The subject matter of the contract are the goods and services specified by the customer in the order and stated in the order and/or order confirmation, at the prices stated in the online shop. Errors and omissions excepted, particularly with regard to the availability of goods.
The quality of the ordered goods is determined by the product descriptions in the online shop. Images on the website may not accurately represent the products; in particular, colors may vary considerably for technical reasons. Images are for illustrative purposes only and may differ from the actual product. Technical data, weight, dimensions, and performance specifications are stated as precisely as possible, but may contain the usual deviations. The properties described here do not constitute defects in the products delivered by the seller.
7 SHIPPING & RETURN COSTS
Delivery of goods is subject to availability. Processing time is between 1 and 5 business days. Shipping costs will be communicated to the customer during the ordering process.
The costs for returning the order are to be borne by the customer. Any customs fees incurred for delivery and return shipments from non-EU countries are not borne by the seller. For further questions regarding any customs fees, please contact your local customs office.

C. CANCELLATION POLICY
Right of withdrawal
By law, you have the right to withdraw from this contract within 14 days without giving any reason.
The cancellation period is 14 days
a. from the day on which you or a third party other than the carrier designated by you takes possession of the goods OR
b. in the case of a contract for several goods within the framework of a single order, from the day on which you or a third party other than the carrier designated by you takes possession of the last goods OR
c. in the case of a contract for the delivery of goods in several partial deliveries or pieces, from the day on which you or a third party other than the carrier designated by you takes possession of the last partial delivery or the last piece.

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To comply with the cancellation period, it is sufficient for you to send your notification of your exercise of the right of cancellation before the cancellation period has expired.
Consequences of revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will we charge you any fees for this refund.
We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods promptly and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract to

to return or hand over the goods. This deadline is met if you send the goods before the expiry of the 14-day period.
You will bear the direct cost of returning the goods if, due to their nature, they can be returned by post. For goods that cannot be returned by post, you will bear the direct cost of returning the goods up to a maximum of €599.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
NOTE: The extent of proper inspection depends on the handling of the goods that would normally be possible or permitted in a business premises.
Exceptions to the right of withdrawal
You do not have the right to withdraw from the contract for goods that are made to CUSTOMER SPECIFICATIONS or are clearly tailored to personal needs, or for goods that are delivered sealed and are not suitable for return for health protection or hygiene reasons if their seal has been removed after delivery.

9 RESERVATION OF TITLE
The delivered goods remain the property of the seller until full payment has been made.
10 WARRANTY AND LIABILITY
If goods are delivered with obvious transport damage, the customer is asked to contact the seller immediately. (office@home36.at)
11 FINAL PROVISIONS
Complaints regarding obvious defects or obviously incomplete or incorrect deliveries must be notified to us in writing immediately, but no later than two days after receipt of the goods. The contractual partner bears the burden of proof for timely notification (notice of defects).
Other defects must be reported in writing immediately after they are discovered.
If the notice of defects is not submitted in a timely manner, our delivery shall be deemed to have been approved.
Should any provision of these General Terms and Conditions be invalid, this shall not affect the remaining provisions. The relevant statutory provisions shall apply in place of the invalid provision.
Austrian law applies.
The place of performance and jurisdiction for deliveries and payments, as well as all disputes arising between the parties, is Vienna, to the extent permitted by law. For end consumers, the place of performance and jurisdiction is the buyer's registered office.
